General terms and conditions for online purchases on www.elmaviaggi.it
Elmaviaggi S.n.c. registered office: Via S. Vitale, 20, 23032 Bormio (SO), VAT no. 00950630145 (henceforth known as the Vendor) makes it possible for all users to buy its transfer services online via the site www.elmaviaggi.it;
1) General notes
These general conditions of sale apply only to online sales of transport services.
The customer is invited to print and keep these general terms and conditions.
2) Note on luggage
Every passenger can bring a small wheeled suitcase of 40 cm x 20 cm x 25 cm and a small piece of hand luggage (rucksack or bag). Any extra baggage larger than 40 cm x 20 cm x 25 cm must be declared at the moment of booking as a ‘large suitcase’, indicating its weight and size. If it is not declared at the time of booking, Elmaviaggi has the right to refuse service.
3) Public offer
The transport services and relative prices stated above constitute a public offer. The sales contracts stipulated on the site are with Elmaviaggi S.n.c.
4) Prices
All prices for transport services online include VAT. Elmaviaggi S.n.c. reserves the right to modify at any time, without forewarning, the online prices of these services as well as modify or remove them from the list of services offered online at any time at its own discretion. On the weekends and in the high season (from 12-26-2019 to 01-15-2020) small surcharges are applied.
5) Bookings
Bookings must be made online through the booking procedure on the site.
The customer will have successfully completed the transaction if there is no error message on the site.
The sales contract is completed once the order has been received by Elmaviaggi S.n.c.; upon conclusion the vendor’s booking system will confirm, in real time, the registration of the booking via e-mail, to include the order number, date, the total price of the booking and in case of payment via bank transfer, full bank details for the transfer.
6) Payment and order fulfillment
Payment can be made online via PayPal. The order is processed when payment is made.
7) Guarantees
Elmaviaggi S.n.c. offers a guarantee according to the terms of the law both with regards to the consumer and the non-consumer.
8) Communication
All communication can be addressed to Elmaviaggi S.n.c. via the e-mail address in the footer of the website.
9) Court of jurisdiction
Eventual controversies connected to the interpretation or execution of these general conditions or the sales contract governing online sales will be subject exclusively to the jurisdiction of the tribunal court in Sondrio, or resolved in accordance with the Italian Consumer Code.
